Doctor who admitted dealing drugs to get his license back









A West Hollywood psychiatrist who pleaded guilty to felony drug dealing after pills he prescribed turned up for sale on Craigslist will be able to get his medical license back in a year under an agreement announced Friday by the Medical Board of California.


The sanction, though harsh by board standards, allows Nathan Kuemmerle, 40, a former methamphetamine user, to treat patients again as soon as next February.


As a result of the criminal charges, Kuemmerle had lost his privilege to prescribe controlled substances and must apply to the U.S. Drug Enforcement Administration if he wants it restored. Kuemmerle agreed to undergo random drug testing, enroll in a physician ethics class and seek psychological counseling, among other conditions.





Kuemmerle was featured in a Dec. 30 Times report on the state's failure to use its vast prescription drug database to identify reckless prescribing by physicians.


In 2009, Kuemmerle was the state's most prolific prescriber of Adderall, a widely abused stimulant, records show. His prescribing drew scrutiny only after Redondo Beach narcotics detectives arrested a suspected drug dealer peddling Adderall pills on Craigslist. The suspect identified Kuemmerle as the source of the prescriptions.


Two months later, a second suspected drug dealer arrested in Arizona also pointed authorities to Kuemmerle. When drug agents checked the state's prescription drug database, known as CURES, they discovered that in 2009 Kuemmerle prescribed nearly four times as many of the highest-dose Adderall pills as the No. 2 doctor on the list, records show. Additionally, records show, he was the state's No. 2 prescriber of the most highly controlled narcotic painkillers.


Kuemmerle was arrested and pleaded guilty in 2011 to drug dealing and was sentenced to three years' probation.


Federal agents had alleged that Kuemmerle was selling prescriptions to people he had never seen, much less examined, records show. Kuemmerle wrote an average of 15 prescriptions per day for controlled substances over a four-year period, a figure a medical expert described as "remarkably high," records show.


Narcotics detectives said they were amazed that Kuemmerle was able to prescribe so many drugs undetected for so long, even though state authorities had access to a database that collected a record every time a pharmacy dispensed one.


Kuemmerle could not be reached for comment.


The types of drugs Kuemmerle prescribed are fueling an epidemic of overdose deaths that has drawn the attention of drug enforcement agencies, lawmakers and medical authorities. The response has largely focused on illicit sources of prescription drugs, such as pharmacy robberies and teens stealing from home medicine cabinets.


But a Times investigation of more than 3,700 prescription drug deaths in Southern California found that nearly half of the decedents had a doctor's prescription for one or more of the medications that caused or contributed to their deaths.


The U.S. Centers for Disease Control and Prevention has urged states to mine prescription drug monitoring databases to identify and stop reckless prescribers. At least six states do so. California does not.

BlackBerry doesn’t need to catch up with Android and iOS overnight, it needs to live to fight another day






The biggest criticism of BlackBerry’s (RIMM) revamped mobile operating system and smartphone line so far is that they don’t give iOS or Android users any compelling reasons to switch brands. And this is certainly true — BlackBerry 10, for all its virtues, doesn’t do anything significantly better than the top two mobile operating systems and seems designed mostly to please the faithful and not win new converts. At the same time, I think this sort of criticism is based on somewhat unrealistic expectations for what a revamped BlackBerry would be able to achieve in its first iteration. Put simply, making its own loyal fans happy might have been the best that BlackBerry could do in this particular product cycle.

Before we go further with this line of thinking, we should remind ourselves of the truly dire state that BlackBerry CEO Thorsten Heins found the company in when he took it over just over a year ago.

Longtime customers were fleeing BlackBerry for iOS and Android after BlackBerry repeatedly shot itself in the foot by releasing devices that featured outdated hardware (the first-generation BlackBerry Torch) or that lacked some of the core capabilities that BlackBerry customers had come to expect (the BlackBerry PlayBook and its lack of native corporate email without a “bridge” connection). The company also got caught completely flat-footed by the rise of mobile apps as a vital component of the global smartphone ecosystem and typically wouldn’t get big-name apps on its platform for more than a year after they’d been out on iOS and Android, if at all.


Let’s also recall that when Heins announced last summer that BlackBerry 10 would be delayed until the first quarter of 2013, many of us wondered if the new operating system would ever be released or if the company would simply collapse under the weight of competitive pressures. That Heins has been able to not only get BlackBerry 10 launched but also get more than 100 carriers on board with the new platform is a pretty impressive feat. Add in that Heins has been able to score commitments from some important apps such as Skype, WhatsApp and Amazon Kindle, and you begin to appreciate just how far BlackBerry has come from almost going over the brink.


Of course, none of this is even close to being enough to make BlackBerry a force in the mobile industry anytime soon. But if ardent BlackBerry fans buy up the new BlackBerry 10 handsets and if the company maintains its corporate clients, it may be enough to let the company live to fight another day.


Benedict Evans, a strategy consultant for Enders Analysis, has done some back-of-the-envelope calculations and estimates BlackBerry could sell as many as 20 million BlackBerry 10 smartphones in 2013, although he admits this number could be overly optimistic by as much as 50%. But even if BlackBerry sells just 15 million BB10 phones this year, that could be enough to give the company some breathing room while it works to recruit more app developers and generally improve its new operating system’s functionality.


This is not to say that BlackBerry has an easy road from here — the odds are still very much against it. But just as Rome wasn’t built in a day, no one should have expected BlackBerry to return to its former glory overnight. As much as BlackBerry fans would love to see their favorite devices rise up and crush iOS and Android, that sort of comeback was never in the cards. The best BlackBerry can hope is that they’ve stopped the bleeding and can continue building from here.

Former New York mayor Ed Koch moved to hospital intensive care






NEW YORK (Reuters) – Former New York City Mayor Ed Koch was moved to a hospital intensive care unit on Thursday, his spokesman said, in a sign that his health could be deteriorating.


Koch spokesman George Arzt said the 88-year-old politician, who earned a reputation for being as outspoken as he is colorful, was being moved so his cardiologist could better monitor his condition. Koch has been treated at New York-Presbyterian Hospital on and off since January 19.






Koch was re-admitted to the hospital on Monday after complaining of shortness of breath. He was unable to attend Tuesday’s premier of “Koch,” a documentary about his turbulent three terms as mayor, at the Museum of Modern Art.


In New York‘s City Hall from 1978 to 1989, Koch – with his trademark phrase “How’m I Doing?” – was seen as the personification of New York City.


“I don’t think there was anybody who had more fun being mayor as Ed Koch,” City Council Speaker Christine Quinn, who is in the race to be the city’s next mayor, said while walking the premier’s red carpet.


Koch was credited with helping to restore confidence in the city at a time when it stood at the brink of financial ruin. Under his leadership, New York City regained its fiscal footing and underwent a construction boom.


His time in office was also marked by corruption among his political allies, racial tensions, a rise in cases of AIDS and HIV, and an increase in homelessness and the crime rate.

Ferrol Sams, Doctor Turned Novelist, Dies at 90


Ferrol Sams, a country doctor who started writing fiction in his late 50s and went on to win critical praise and a devoted readership for his humorous and perceptive novels and stories that drew on his medical practice and his rural Southern roots, died on Tuesday at his home in Lafayette, Ga. He was 90.


The cause, said his son Ferrol Sams III, also a doctor, was that he was “slap wore out.”


“He lived a full life,” his son said. “He didn’t leave anything in the tank.”


Dr. Sams grew up on a farm in the rural Piedmont area of Georgia, seven mud-road miles from the nearest town. He was a boy during the Depression; books meant escape and discovery. He read “Robinson Crusoe,” then Mark Twain and Charles Dickens. One of his English professors at Mercer University, in Macon, suggested he consider a career in writing, but he chose another route to examining the human condition: medical school.


When he was 58 — after he had served in World War II, started a medical practice with his wife, raised his four children and stopped devoting so much of his mornings to preparing lessons for Sunday school at the Methodist church — he began writing “Run With the Horsemen,” a novel based on his youth. It was published in 1982.


“In the beginning was the land,” the book begins. “Shortly thereafter was the father.”


In The New York Times Book Review, the novelist Robert Miner wrote, “Mr. Sams’s approach to his hero’s experiences is nicely signaled in these two opening sentences.”


He added: “I couldn’t help associating the gentility, good-humored common sense and pace of this novel with my image of a country doctor spinning yarns. The writing is elegant, reflective and amused. Mr. Sams is a storyteller sure of his audience, in no particular hurry, and gifted with perfect timing.”


Dr. Sams modeled the lead character in “Run With the Horsemen,” Porter Osborne Jr., on himself, and featured him in two more novels, “The Whisper of the River” and “When All the World Was Young,” which followed him into World War II.


Dr. Sams also wrote thinly disguised stories about his life as a physician. In “Epiphany,” he captures the friendship that develops between a literary-minded doctor frustrated by bureaucracy and a patient angry over past racism and injustice.


Ferrol Sams Jr. was born Sept. 26, 1922, in Woolsey, Ga. He received a bachelor’s degree from Mercer in 1942 and his medical degree from Emory University in 1949. In his addition to his namesake, survivors include his wife, Dr. Helen Fletcher Sams; his sons Jim and Fletcher; a daughter, Ellen Nichol; eight grandchildren; and nine great-grandchildren.


Some critics tired of what they called the “folksiness” in Dr. Sams’s books. But he did not write for the critics, he said. In an interview with the Georgia Writers Hall of Fame, Dr. Sams was asked what audience he wrote for. Himself, he said.


“If you lose your sense of awe, or if you lose your sense of the ridiculous, you’ve fallen into a terrible pit,” he added. “The only thing that’s worse is never to have had either.”

Media Decoder Blog: In Wake of Restructuring, NBC News President Quits

The longest-serving president of any of the three network news divisions, Steve Capus of NBC News, stepped down from his position on Friday, six months after Comcast restructured its news units in a way that diminished his authority.

Pat Fili-Krushel, chairwoman of the NBCUniversal News Group, said in a brief telephone interview on Friday that she would “cast a wide net” while searching for a successor to Mr. Capus. In the interim, the leaders of the news division will report directly to her.

Ms. Fili-Krushel became Mr. Capus’s boss last July when Steve Burke, the chief executive of NBCUniversal, consolidated all of NBC’s news units — NBC News, the cable news channels MSNBC and CNBC, and its stake in the Weather Channel — under a new umbrella, the NBCUniversal News Group. Mr. Burke asked Ms. Fili-Krushel, one of his most trusted lieutenants, to run it, while keeping Mr. Capus and the heads of the other units in place.

Ms. Fili-Krushel worked early in her career at HBO and Lifetime. A veteran of the Walt Disney Company, where she helped program ABC, and  Time Warner, where she was an administrator, she is by her own admission not a journalist.  But now she is, by default, the highest-ranking woman in the American television news industry — not just at the moment, but in the history of the medium. The heads of the news divisions at ABC and CBS are men, as are the heads of the Fox News Channel, CNN, and Bloomberg.

Ms. Fili-Krushel has kept a low public profile, but has been a forceful presence behind the scenes, recently moving from her office on the 51st floor of 30 Rockefeller Center, near Mr. Burke’s, to a new one on the third floor, where NBC News is based. On Friday, she said she had spent her first six months “learning, listening and getting to know the players here.” She called the News Group an “unbelievably strong organization.”

Though Mr. Capus’s exit saddened many at NBC News on Friday, it came as little surprise. He had previously reported directly to Mr. Burke, but after the restructuring he reported to Ms. Fili-Krushel, and he made no secret of his unhappiness with the change. His contract had a clause that allowed him to leave in the event that he no longer reported to Mr. Burke, according to two people with direct knowledge of the arrangement at NBC, and he decided to exercise that right after months of contemplation. The people insisted on anonymity because they were not authorized by the network to speak publicly.

Mr. Capus told Ms. Fili-Krushel of his intent to leave last Friday. It is likely that he would have left sooner, but a series of major news stories kept him busy late last year — including Hurricane Sandy, the presidential election and the school shooting in Newtown, Conn. Mr. Capus also oversaw the network’s response to the kidnapping of Richard Engel and an NBC News crew in Syria last month.

“It has been a privilege to have spent two decades here, but it is now time to head in a new direction,” he wrote in an e-mail to staff members on Friday afternoon.

Mr. Capus guided NBC through a revolutionary time in news-gathering and distribution. He maintained the news division’s profitability, managed tensions between NBC News and its increasingly liberal cable channel MSNBC, and fostered new business ventures like an in-house production company and an annual education summit. Last year, he unwound an old deal with Microsoft to give the news division complete control over its Web site, now named NBCNews.com, for the first time.

Ms. Fili-Krushel wrote in a separate e-mail to staff members that “NBC News is America’s leading source of television news and Steve has been a big part of that success.”

NBC News is the producer of the most popular evening newscast in the country. But its single biggest source of profits, the morning show “Today,” fell to second place last year, behind ABC’s “Good Morning America,” for the first time since the 1990s. The decline caused widespread anxiety inside the news division and speculation that Mr. Capus would be relieved of his duties.

Inside NBC, both Mr. Capus and the executive producer of “Today,” Jim Bell, received much of the blame for the botched removal of Ann Curry from “Today” last June, which worsened the show’s already tenuous position in the ratings. Ms. Fili-Krushel was put in charge just a few weeks later.

Mr. Bell was replaced at “Today” last fall and is now the executive producer for NBC Olympics. Savannah Guthrie is now the co-host of “Today,” and Ms. Curry is a national and international correspondent for the network, but is rarely seen. Mr. Capus’s exit was seen by some at the network as the last shoe that had to drop.

In his e-mail to staff members, Mr. Capus called it an “extremely difficult decision to walk away,” noting that he started at NBC as a producer 20 years ago this month. He did not make any mention of what he would do next. “Journalism is, indeed, a noble calling, and I have much I hope to accomplish in the next phase of my career,” he wrote.

“Today” continues to lose to ABC’s “Good Morning America” among total viewers, but lately it has won a few weeks in the 25- to 54-year-old demographic that advertisers covet.

“NBC Nightly News” has more successfully fended off ABC’s “World News,” despite an aggressive push by ABC. Mr. Capus said, “NBC News has grown in all key metrics — from ratings and reputation to profitability.”

Cardinal Mahony relieved of duties over handling of abuse









In a move unprecedented in the American Catholic Church, Los Angeles Archbishop Jose Gomez announced Thursday that he had relieved his predecessor, Cardinal Roger M. Mahony, of all public duties over his mishandling of clergy sex abuse of children decades ago.


Gomez also said that Auxiliary Bishop Thomas J. Curry, who worked with Mahony to conceal abusers from police in the 1980s, had resigned his post as a regional bishop in Santa Barbara.


The announcement came as the church posted on its website tens of thousands of pages of previously secret personnel files for 122 priests accused of molesting children.





"I find these files to be brutal and painful reading. The behavior described in these files is terribly sad and evil," Gomez wrote in a letter addressed to "My brothers and sisters in Christ."


The release of the records and the rebuke of the two central figures in L.A.'s molestation scandal signaled a clear desire by Gomez to define the sexual abuse crisis as a problem of a different era — and a different archbishop.


"I cannot undo the failings of the past that we find in these pages. Reading these files, reflecting on the wounds that were caused has been the saddest experience I've had since becoming your Archbishop in 2011," Gomez wrote.


The public censure of Mahony, whose quarter-century at the helm of America's largest archdiocese made him one of the most powerful men in the Catholic Church, was unparalleled, experts said.


"This is very unusual and shows really how seriously they're taking this. To tell a cardinal he can't do confirmations, can't do things in public, that's extraordinary," said the Rev. Thomas Reese, a Jesuit priest and Georgetown University fellow.


An archdiocese spokesman, Tod Tamberg, said that beyond canceling his confirmation schedule, Mahony's day-to-day life as a retired priest would be largely unchanged. He resides at a North Hollywood parish, and Tamberg said he would remain a "priest in good standing." He can continue to celebrate Mass and will be eligible to vote for pope until he turns 80 two years from now, Tamberg said.


The move further stained the legacy of Mahony, a tireless advocate for Latinos and undocumented immigrants whose reputation has been marred over the last decade by revelations about his treatment of sex abuse allegations.


Before Gomez's announcement, Mahony had weathered three grand jury investigations and numerous calls for his resignation. He stayed in office until the Vatican's mandatory retirement age of 75. No criminal charges have been filed against Mahony or anyone in the church hierarchy.


Terrence McKiernan, president of bishopaccountability.org, said that in a religious institution that values saving face and protecting its own, Gomez's decision to publicly criticize an elder statesman of the church and his top aide was striking.


"Even when Cardinal [Bernard] Law was removed in Boston, which was arguably for the same offenses, this kind of gesture was not made," he said.


Law left office in 2002 amid mounting outrage over his transfer of pedophile priests from parish to parish, but the church presented his departure as of his own accord and he was later given a highly coveted Vatican job in Rome.


Bishop Thomas J. O'Brien of Phoenix relinquished some of his authority in a deal with prosecutors to avoid criminal charges for his handling of abuse cases, but he kept his title and many of his duties. A Kansas City bishop convicted last year of failing to report child abuse retained his position.


The Rev. Thomas Doyle, a canon lawyer and Dominican priest who has testified across the nation as an expert witness in clergy sex abuse cases, said the Vatican would have "absolutely" been consulted on a decision of this magnitude.


"This is momentous, there is no question," he said. "For something like this to happen to a cardinal.... The way they treat cardinals is as if they're one step below God."


Gomez's decision capped a two-week period in which the publication of 25-year-old files fueled a new round of condemnation of the L.A. archdiocese. The files of 14 clerics accused of abuse became public in a court case last Monday. They laid out in Mahony and Curry's own words how the church hierarchy had plotted to keep law enforcement from learning that children had been molested at the hands of priests.


To stave off investigations, Mahony and Curry gave priests they knew had abused children out-of-state assignments and kept them from seeing therapists who might alert authorities.


Mahony and Curry both issued apologies, with the cardinal saying he had not realized the extent of harm done to children until he met with victims during civil litigation. "I am sorry," he said.

CES gadget show host drops CNET as awards picker






LOS ANGELES (AP) — The industry group that hosts the annual gadget show known as International CES is dropping reviews website CNET as the picker of its “Best of CES” awards. It says CNET reviewers’ objectivity was compromised by the site’s corporate parent, CBS Corp.


The Consumer Electronics Association also elevated the CNET writers’ initial pick for the best gadget of the show, Dish Network Corp.‘s Hopper with Sling, to co-winner along with a gaming tablet called Razer Edge.






CBS had annulled an earlier vote by CNET staff to award the Hopper because it is in a legal dispute with Dish over the product. The Hopper allows users to automatically skip commercials from prime-time TV shows, undercutting a key source of revenue for CBS, advertising.


After CBS removed the Hopper from contention, CNET staff re-voted and chose Razer Edge as the winner.


The association says it is looking for a new partner for its awards.


The association’s president, Gary Shapiro, blasted CBS in an opinion article in the USA Today newspaper on Wednesday, saying its interference damaged its own editorial integrity. CBS also owns TV shows such as “60 Minutes,” ”CBS Evening News” and “Face the Nation.”


“It not only tainted the CES awards, but it hurt one of the world’s classiest media companies,” Shapiro wrote.


The association, which has hosted the gadget show since 1967, had contracted with CNET to pick the awards since the 2007 show. It normally chooses not to get involved, partly because of its relationship with its many exhibitors.


Mark Larkin, the general manager of CNET, said in a statement the website is “committed to delivering in-depth coverage of consumer electronics” and will continue to cover the show, as it has for more than a decade.


Dish appeared to bask in the controversy, which drew more attention to its device.


“We appreciate the International CES’ decision to stand with the consumer in the acknowledgement of this award,” said Dish CEO Joseph Clayton in a statement. “I regret that the award has come in the face of CBS’ undermining of CNET’s editorial independence.”

Appeals judges: Anti-paparazzi law appears legal






LOS ANGELES (AP) — An appeals panel says California’s anti-paparazzi statute appears to be constitutional based on a brief filed by prosecutors.


A preliminary statement by three judges in Los Angeles requires a judge who dismissed charges aimed at a paparazzo who authorities say was driving recklessly to review his order. The judge may stick to his ruling, which would trigger a full appeal, or he could schedule further arguments on the case against freelance photographer Paul Raef.






Raef was the first person charged under the new law after a high-speed chase involving Justin Bieber last year.


Superior Court Judge Thomas Rubinson dismissed two charges in November, ruling the law is too broad and is unconstitutional.


Raef’s attorney David S. Kestenbaum says he is asking Rubinson to stand by his ruling and allow a full appeal.

The New Old Age Blog: Caregiving, Laced With Humor

“My grandmother, she’s not a normal person. She’s like a character when she speaks. Every day she’s playing like she’s an actress.”

These are words of love, and they come from Sacha Goldberger, a French photographer who has turned his grandmother, 93-year-old Frederika Goldberger, into a minor European celebrity.

In the photos, you can see the qualities grandson and grandmother have in common: a wicked sense of humor, an utter lack of pretension and a keen taste for theatricality and the absurd.

This isn’t an ordinary caregiving relationship, not by a long shot. But Sacha, 44 years old and unmarried, is deeply devoted to this spirited older relation who has played the role of Mamika (“my little grandmother,” translated from her native Hungarian) in two of his books and a photography exhibition currently underway in Paris.

As for Frederika, “I like everything that my grandson does,” she said in a recent Skype conversation from her apartment, which also serves as Sacha’s office. “I hate not to do anything. Here, with my grandson, I have the feeling I am doing something.”

Their unusual collaboration began after Frederika retired from her career as a textile consultant at age 80 and fell into a funk.

“I was very depressed because I lived for working,” she told me in our Skype conversation.

Sacha had long dreamed of creating what he calls a “Woody Allen-like Web site with a French Jewish humor” and he had an inspiration. What if he took one of the pillars of that type of humor, a French man’s relationship with his mother and grandmother, and asked Frederika to play along with some oddball ideas?

This Budapest-born baroness, whose family had owned the largest textile factory in Hungary before World War II, was a natural in front of the camera, assuming a straight-faced, imperturbable comic attitude whether donning a motorcycle helmet and goggles, polishing her fingernails with a gherkin, wearing giant flippers on the beach, lighting up a banana, or dressed up as a Christmas tree with a golden star on her head. (All these photos and more appear in “Mamika: My Mighty Little Grandmother,” published in the United States last year.)

“It was like a game for us, deciding what crazy thing we were going to do next, how we were going to keep people from being bored,” said Sacha, who traces his close relationship with his grandmother to age 14, when she taught him how to drive and often picked him up at school. “Making pictures was a very good excuse to spend time together.”

“He thought it was very funny to put a costume on me,” said Frederika. “And I liked it.”

People responded enthusiastically, and before long Sacha had cooked up what ended up becoming the most popular character role for Frederika: Super Mamika, outfitted in a body-hugging costume, tights, a motorcycle helmet and a flowing cape.

His grandmother was a super hero of sorts, because she had helped save 10 people from the Nazis during World War II, said Sacha. He also traced inspiration to Stan Lee, a Jewish artist who created the X-Men, The Hulk and the Fantastic Four for Marvel comics. “I wanted to ask what happens to these super heroes when they get old in these photographs with my grandmother.”

In our Skype conversation, Sacha confessed to anxiety about losing his grandmother, and said, “I always was very worried about what would happen if my grandmother disappeared. Because she is exceptional.”

“I am not normal,” Frederika piped up at his side, her face deeply wrinkled, her short hair beautifully coiffed, seemingly very satisfied with herself.

“So, making these pictures to me is the best thing that could happen,” Sacha continued, “because now my grandma is immortal and it seems everyone knows her. I am giving to everybody in the world a bit of my grandma.”

This wonderful expression of caring and creativity has expanded my view of intergenerational relations in this new old age. What about you?

DealBook: Doubt Is Cast on Consultants Hired to Fix Banks’ Abuses

Federal authorities are scrutinizing private consultants hired to clean up financial misdeeds like money laundering and foreclosure abuses, taking aim at an industry that is paid billions of dollars by the same banks it is expected to police.

The consultants operate with scant supervision and produce mixed results, according to government documents and interviews with prosecutors and regulators. In one case, the consulting firms enabled the wrongdoing. The deficiencies, officials say, can leave consumers vulnerable and allow tainted money to flow through the financial system.

“How can you be independent if you’re hired by the entity you’re reviewing?” Senator Jack Reed, Democrat of Rhode Island, who sits on the Senate Banking Committee, said.

The pitfalls were exposed last month when federal regulators halted a broad effort to help millions of homeowners in foreclosure. The regulators reached an $8.5 billion settlement with banks, scuttling a flawed foreclosure review run by eight consulting firms. In the end, borrowers hurt by shoddy practices are likely to receive less money than they deserve, regulators said.

On Thursday, Senator Elizabeth Warren, Democrat of Massachusetts, and Representative Elijah Cummings, Democrat of Maryland, announced that they would open an investigation into the foreclosure review, seeking “additional information about the scope of the harms found.”

Critics concede that regulators have little choice but to hire outsiders for certain responsibilities after they find problems at the banks. The government does not have the resources to ensure that banks follow the rules. Still, consultants like Deloitte & Touche and the Promontory Financial Group can add to regulators’ headaches, the government documents and interviews indicate. Some banks that work with consultants continue to run afoul of the law. At other times, consultants underestimate the extent of the misdeeds or facilitate them, preventing regulators from holding institutions accountable.

Now, regulators and lawmakers are rethinking their relationship with the consultants. Officials at the Federal Reserve, which oversees many large banks, are questioning the prudence of relying on consultants so heavily, said two people with direct knowledge of the matter.

When the Office of the Comptroller of the Currency penalized JPMorgan Chase last month for breakdowns in money-laundering controls, it imposed stricter requirements, ordering the bank to hire a consultant with “specialized experience” in money laundering and to ensure that the firm “not be subject to any conflict of interest.” In a separate action against the bank related to a $6 billion trading loss last year, the agency opted not to mandate an outside consultant at all.

While the comptroller’s office will continue requiring consultants in certain cases, some agency officials are worried about the quality of the work, as well as the consultants’ independence, according to three government officials briefed on the matter.

Since the financial crisis, regulators have increasingly relied on consultants. The comptroller’s office ordered banks to hire consultants in more than 130 enforcement actions since 2008, or nearly 15 percent of the cases.

It can be a lucrative business. In 2011, regulators mandated that 14 banks employ consultants to determine whether homeowners were wrongfully evicted. Over 14 months, the consultants collected about $2 billion in fees, according to regulators and bank officials.

Those fees amounted to more than half of what homeowners will receive under the $8.5 billion settlement that ended the review. As part of the deal, officials will disburse $3.3 billion to 3.8 million borrowers in foreclosure.

According to consultants and regulators, the broad review was plagued with inefficiencies. For example, Promontory initially instructed employees to calculate lawyers’ fees for each loan, to assess if borrowers were overcharged. Later, it scrapped the original procedure, only to reverse the policy again two weeks later, according to two reviewers who worked for Promontory.

“From Day 1, Promontory strove to conduct its review work as thoroughly and independently as possible,” a spokesman for the firm, Christopher Winans, said in a statement. “Our overarching concern at all times was to serve the best interests of borrowers.”

Some lawmakers question whether a consultant’s regulatory connections helped it secure contracts. PricewaterhouseCoopers, which has a stable of former Securities and Exchange Commission officials, won much of the foreclosure review work, signing deals with four banks, including Citigroup. Promontory, the firm examining loans for Wells Fargo, Bank of America and PNC, was founded in 2000 by the former head of the comptroller’s office, Eugene A. Ludwig.

When the contracts were initially awarded, some housing advocates complained that consulting firms could not objectively evaluate banks with which they had pre-existing business relationships. The comptroller’s office said it vetted the firms to spot such potential conflicts, and argued that the process provided swifter relief for homeowners than if the government had hired the companies directly through a lengthy contracting process.

But concerns persisted. Deloitte, which won the contract to review JPMorgan’s loans, had previously audited Washington Mutual and Bear Stearns, two firms JPMorgan acquired during the financial crisis. In May, the comptroller’s office replaced Allonhill, the consultant for Aurora Bank, after the firm disclosed that it had already reviewed some “of the same pool of loans” as part of an earlier contract.

“It’s clear from the foreclosure settlement that oversight over consultants was inadequate and the review process was deeply flawed,” said Representative Carolyn B. Maloney, Democrat of New York, who recently pressed regulators to detail how consultants were paid. People close to the review say consultants relied on a process that the comptroller’s office designed in 2011, under previous leadership.

“This was a very complex process,” a spokesman for the comptroller said. “Throughout the process, regulators provided continuous oversight, guidance and were available to discuss issues.” The agency also performs spot checks on the consultants.

Still, the foreclosure review highlighted broader concerns about the role consultants play.

Since the financial crisis, the comptroller’s office has issued nearly 20 enforcement actions against banks that had already hired consultants to help iron out problems, according to government documents. While consultants cannot be expected to remedy every last issue at the banks, the actions raise questions about the effectiveness of their work.

When HSBC, the British bank, was sanctioned in 2003 over porous money-laundering controls, the bank turned to Deloitte to review its compliance, an official briefed on the matter said. Deloitte also worked for HSBC from 2006 to 2008, the person said, building a system to monitor money flows more effectively. But the bank ran into trouble in 2010 over similar issues, as highlighted in a recent scathing report by the Senate’s Permanent Subcommittee on Investigations.

As part of a regulatory order, HSBC again hired Deloitte, this time to assess the number of times the bank failed to report suspicious transactions. Deloitte, three officials said, generously bundled hundreds of missed transfers into a single report. That helped save the bank from some government fines.

Despite the undercounting, HSBC still paid a record $1.9 billion last year to settle accusations that it enabled drug cartels to move money through its American subsidiaries.

In a statement, a spokesman for the firm said, “Deloitte fully stands behind the quality and integrity of its work on behalf of regulatory authorities.”

Deloitte has also been suspected of helping institutions cloak illicit transfers of money to rogue nations around the globe. In August, New York’s top banking regulator, Benjamin M. Lawsky, accused Deloitte of helping the British bank Standard Chartered flout American sanctions.

The consulting firm was hired to flag suspicious transfers routed through Standard Chartered’s New York branches. Instead, it instructed bankers on how to escape regulatory scrutiny, according to state court documents.

Deloitte turned over “highly confidential information” from which the bank gleaned insight into “regulators’ concerns and strategies,” the court documents said. The firm later doctored its report to regulators, Mr. Lawsky said, deliberately removing some illegal transfers on behalf of Iranian clients. In an e-mail, a Deloitte partner admitted that a report on the transactions was a “watered-down version.”

The authorities never took legal action against Deloitte, and federal officials noted in a separate settlement agreement that Standard Chartered employees withheld critical information from the consulting firm.

Despite these concerns, regulators are turning to a familiar source to help Standard Chartered. As part of a $327 million settlement last year, the bank is required to hire “an independent consultant.”

Man behind Manti Te'o hoax wants to 'heal'









The 22-year-old Palmdale man who created Manti Te'o's fake girlfriend broke his silence for the first time, saying he perpetrated the elaborate hoax to build a relationship with the football star.


Ronaiah Tuiasosopo pretended to be Te'o's girlfriend, Lennay Kekua, for months, communicating on the phone and through social media. Tuiasosopo went so far as to disguise his voice to sound like a woman's when he spoke to Te'o on the phone, his attorney, Milton Grimes, said in an interview with The Times.


Grimes said his client decided to come clean about the hoax in an attempt to "heal."





"He knows that if he doesn't come out and tell the truth, it will interfere with him getting out of this place that he is in," Grimes said.


TV talk show host Dr. Phil McGraw, who spoke with Tuiasosopo for an interview set to air this week, described the 22-year-old as "a young man that fell deeply, romantically in love" with Te'o. McGraw, speaking on the "Today" show, said he asked Tuiasosopo about his sexuality, and Tuiasosopo said he was "confused."


In a short clip of the "Dr. Phil" interview, Tuiasosopo told McGraw that he wanted to end his relationship with Te'o because he "finally realized that I just had to move on with my life."


"There were many times where Manti and Lennay had broken up before," Tuiasosopo said. "They would break up, and then something would bring them back together, whether it was something going on in his life or in Lennay's life — in this case, in my life."


Tuiasosopo's comments add another twist to a story so bizarre that reporters from across the country have converged on Tuiasosopo's home in the Antelope Valley. News of the hoax was first reported earlier this month on the website Deadspin.com.


Tuiasosopo, the report said, was the mastermind behind the hoax and used photos from an old high school classmate and social media to connect Kekua with Te'o.


During the college football season, Te'o repeatedly spoke to the media, including The Times, about his girlfriend, the car accident that left her seriously injured and the leukemia that led to her September death. The tale became one of the most well-known sports stories of the year as Te'o led his team to an undefeated season and championship berth.


Te'o has denied any role in the ruse, saying he spent hours on the phone with a woman he thought was Kekua.


Those who know Tuiasosopo said they were baffled when they first learned of his involvement in the hoax. Neighbors and former high school coaches described him as popular, faith-driven and family-oriented.


"I've done a lot of thinking about it," Jon Fleming, Tuiasosopo's former football coach at Antelope Valley High, said in the days after the ruse was revealed. "It's all speculation. He's goofy just like any other kid. The question that comes up in my mind is: 'What could he possibly gain from doing something like this?' It would really surprise me. What would he gain?"


Te'o said in an interview with ESPN that Tuiasosopo called to apologize for the hoax.


"I hope he learns," Te'o said. "I hope he understands what he's done. I don't wish an ill thing to somebody. I just hope he learns. I think embarrassment is big enough."


Diane O'Meara, the Long Beach woman whose photos were used to represent the fake girlfriend, said in an interview with The Times that Tuiasosopo was a high school classmate.


She said he repeatedly asked her for photos and videos of herself.


O'Meara, 23, said that during a six-day period in December, Tuiasosopo contacted her through social media, texting and phone calls about 10 times, asking her to send a photo of herself. Then, after she sent the photo, in part to "get this guy off my back," she said Tuiasosopo messaged her asking for a video clip or another photo.


By that time, his requests were "kind of annoying, kind of pestering," O'Meara said.


Tuiasosopo is seeing a medical professional and "feels as though he needs therapy," Grimes said.


"Part of that therapy is to … tell the truth," he added. "He did not intend to harm [Te'o] in any way. It was just a matter of trying to have a communication with someone."


Grimes said he warned his client that he could face legal consequences for admitting that he falsified his identity on the Internet. But Tuiasosopo insisted that going public was something he had to do.


"This is part of my public healing," Grimes quoted Tuiasosopo as saying.

Dr. Phil says Manti Te’o hoaxer admits to love for linebacker






LOS ANGELES (Reuters) – A California man who has admitted to fabricating Notre Dame linebacker Manti Te‘o’s fake girlfriend in an elaborate hoax told talk show host Phil McGraw he felt a deep romantic love for the football player, McGraw said on Wednesday.


“Here we have a young man that fell deeply, romantically in love,” McGraw told the television morning show “Today” to discuss his two part interview with Ronaiah Tuiasosopo, which will air on “Dr. Phil” on Thursday and Friday.






“I asked him straight up, ‘Was this a romantic relationship with you?,’ and he says yes. I said, ‘Are you then therefore gay?’ And he said, ‘When you put it that way, yes.’ And then he caught himself and said, ‘I am confused,’” McGraw told “Today.”


Te’o has said in a previous media interview he is not gay.


The fake girlfriend hoax involving Te’o, who was a finalist for college football’s highest individual honor the Heisman trophy, caused a sensation when it was revealed earlier this month on news website Deadspin.com.


Tuiasosopo says he played the part over the phone of Lennay Kekua, the fictitious woman who was Te’o's girlfriend in the hoax. Te’o, 22, had spoken about the woman in media interviews, and reports described her surviving a car accident and then dying of leukemia in September.


Te’o has said since the hoax was exposed that he was the victim of an elaborate prank, that he never met Kekua and that his acquaintance Tuiasosopo admitted to him that he was the one who played the part of Lennay.


Dr. Phil said in a segment on “Today” on Wednesday that after an extensive interview with Tuiasosopo, he believes Te’o had no role in creating the hoax.


“Absolutely, unequivocally, no,” McGraw said, in pinning the blame for the scheme on Tuiasosopo.


The NBC morning program also showed some comments Tuiasosopo made in his interview for the “Dr. Phil” daytime program.


“There are many times where Manti and Lennay had broken up,” Tuiasosopo told “Dr. Phil.”


“But something would bring them back together, whether it was something going on in his life or in Lennay’s life, in this case in my life,” Tuiasosopo said.


Tuiasosopo, 22, is from southern California and played high school football in 2005 at Antelope Valley High north of Los Angeles, according to media reports. Tuaisosopo’s attorney had previously told reporters his client was behind the hoax.


Before the hoax was exposed, a photo of a woman who was described as Lennay Kekua was presented in media reports about Te’o and his struggles to overcome her death and that of his grandmother, who actually did pass away.


But the photo of Kekua was taken from a Facebook profile of a California woman who said she was unaware of the scheme, according to Deadspin.com.


Te’o told Katie Couric in a broadcast of her show “Katie” last week that he received a telephone call from the person claiming to be Kekua on December 6 – two days before the Heisman presentation. But he said he was not really certain she never existed until Tuiasosopo’s later confession to him.


The linebacker, during the Katie Couric interview, presented a voice mail he received from the person he said he thought was Kekua. “Doesn’t that sound like a girl?” Te’o told Couric.


Te’o also told Couric he is not gay. “No, far from it,” he said.

‘How I Met Your Mother’ gets final season – and reveals the mother






NEW YORK (TheWrap.com) – “How I Met Your Mother” will be back for a ninth and final season that will reveal – finally – who the mother is.


CBS and 20th Century Fox Television announced Wednesday that the series would be back for one final go-round with series regulars Josh Radnor, Jason Segel, Cobie Smulders, Neil Patrick Harris and Alyson Hannigan, as well as series creators Carter Bays and Craig Thomas.






For eight years, viewers have wondered about the identity of the titular mother – and she will finally be revealed in the final season.

Well: Waiting for Alzheimer's to Begin

My gray matter might be waning. Then again, it might not be. But I swear that I can feel memories — as I’m making them — slide off a neuron and into a tangle of plaque. I steel myself for those moments to come when I won’t remember what just went into my head.

I’m not losing track of my car keys, which is pretty standard in aging minds. Nor have I ever forgotten to turn off the oven after use, common in menopausal women. I can always find my car in the parking lot, although lots of “normal” folk can’t.

Rather, I suddenly can’t remember the name of someone with whom I’ve worked for years. I cover by saying “sir” or “madam” like the Southerner I am, even though I live in Vermont and grown people here don’t use such terms. Better to think I’m quirky than losing my faculties. Sometimes I’ll send myself an e-mail to-do reminder and then, seconds later, find myself thrilled to see a new entry pop into my inbox. Oops, it’s from me. Worse yet, a massage therapist kicked me out of her practice for missing three appointments. I didn’t recall making any of them. There must another Nancy.

Am I losing track of me?

Equally worrisome are the memories increasingly coming to the fore. Magically, these random recollections manage to circumnavigate my imagined build-up of beta-amyloid en route to delivering vivid images of my father’s first steps down his path of forgetting. He was the same age I am now, which is 46.

“How old are you?” I recall him asking me back then. Some years later, he began calling me every Dec. 28 to say, “Happy birthday,” instead of on the correct date, Dec. 27. The 28th had been his grandmother’s birthday.

The chasms were small at first. Explainable. Dismissible. When he crossed the street without looking both ways, we chalked it up to his well-cultivated, absent-minded professor persona. But the chasms grew into sinkholes, and eventually quicksand. When we took him to get new pants one day, he kept trying on the same ones he wore to the store.

“I like these slacks,” he’d say, over and over again, as he repeatedly pulled his pair up and down.

My dad died of Alzheimer’s last April at age 73 — the same age at which his father succumbed to the same disease. My dad ended up choosing neurology as his profession after witnessing the very beginning of his own dad’s forgetting.

Decades later, grandfather’s atrophied brain found its way into a jar on my father’s office desk. Was it meant to be an ever-present reminder of Alzheimer’s effect? Or was it a crystal ball sent to warn of genetic fate? My father the doctor never said, nor did he ever mention, that it was his father’s gray matter floating in that pool of formaldehyde.

Using the jarred brain as a teaching tool, my dad showed my 8-year-old self the difference between frontal and temporal lobes. He also pointed out how brains with Alzheimer’s disease become smaller, and how wide grooves develop in the cerebral cortex. But only after his death — and my mother’s confession about whose brain occupied that jar — did I figure out that my father was quite literally demonstrating how this disease runs through our heads.

Has my forgetting begun?

I called my dad’s neurologist. To find out if I was in the earliest stages of Alzheimer’s, he would have to look for proteins in my blood or spinal fluid and employ expensive neuroimaging tests. If he found any indication of onset, the only option would be experimental trials.

But documented confirmation of a diseased brain would break my still hopeful heart. I’d walk around with the scarlet letter “A” etched on the inside of my forehead — obstructing how I view every situation instead of the intermittent clouding I currently experience.

“You’re still grieving your father,” the doctor said at the end of our call. “Sadness and depression affect the memory, too. Let’s wait and see.”

It certainly didn’t help matters that two people at my father’s funeral made some insensitive remarks.

“Nancy, you must be scared to death.”

“Is it hard knowing the same thing probably will happen to you?”

Maybe the real question is what to do when the forgetting begins. My dad started taking 70 supplements a day in hopes of saving his mind. He begged me to kill him if he wound up like his father. He retired from his practice and spent all day in a chair doing puzzles. He stopped making new memories in an all-out effort to preserve the ones he already had.

Maybe his approach wasn’t the answer.

Just before his death — his brain a fraction of its former self — my father managed to offer up a final lesson. I was visiting him in the memory-care center when he got a strange look on his face. I figured it was gas. But then his eyes lit up and a big grin overtook him, and he looked right at me and said, “Funny how things turn out.”

An unforgettable moment?

I can only hope.

Royal Dutch Shell Posts $5.6 Billion Profit







LONDON — Royal Dutch Shell, Europe’s largest oil company, disappointed the markets Thursday with fourth-quarter earnings of $5.6 billion after one-time items and inventory changes.




The results were 15 percent above the previous year but well below analysts’ expectation of around $6.3 billion.


Stuart Joyner, an analyst at Investec Securities in London, described the results as “a substantial miss.” Shell’s stock price was down about 1 percent in morning trading in London.


The company’s earnings for the year were $25.1 billion, up 2 percent over 2011.


The disappointment was largely due to lower earnings in Shell’s core exploration and production business, mainly because of weak performance in the Americas, where Shell’s multibillion Alaska drilling program has encountered multiple snafus and delays.


Exploration and production earnings were $4.4 billion compared to $5.1 billion the previous year, with the U.S. exploration and production business reporting a $69 million loss, partly due to low natural gas prices.


In another disappointment Shell estimated that it only replaced 44 percent of the reserves of oil and gas that it produced in 2012. That indicated that the company’s exploration effort, despite increased emphasis and spending in recent years, is still not performing well.


The capital investment forecast for 2013 was increased by 10 percent to $33 billion — another worry for the markets, as it suggests that Shell may be having trouble controlling costs.


On the positive side, Shell’s huge Pearl gas-to-liquids plant in Qatar is now fully operational and adding a hefty 235,000 barrels per day of oil equivalent to Shell’s production for the quarter.


Shell said that it was likely to increase its dividend in the first quarter of 2013 to 45 cents a share, a 4.7 percent increase over the first quarter of 2012.


“Shell is competitive and innovative,” the company’s chief executive, Peter Voser, said in a statement. “We are delivering on a strategy that others can’t easily repeat.”


Shell also had cause for relief on Wednesday when a court in The Hague dismissed most aspects of lawsuits brought against it by Nigerian farmers and fishermen seeking damages for pollution from oil spills in the Niger Delta.

Toyota recalls nearly 1 million Corollas, Lexus IS sedans









Toyota is recalling 907,000 vehicles, mostly Corolla models, around the world for faulty air bags and another 385,000 Lexus IS luxury cars for defective wipers.


Toyota Motor Corp. spokesman Naoto Fuse said Wednesday there have been no accidents or injuries related to either of those defects, but the Japanese automaker received 46 reports of problems involving the air bags from North America, and one from Japan.


There were 25 reports of problems related to the windshield wipers.





Being recalled for air bags that can improperly inflate are 752,000 Corolla and Corolla Matrix cars in the U.S. as well as thousands of similar vehicles in Japan, Mexico and Canada, manufactured between December 2001 and May 2004.


The problem windshield wipers can get stuck if there is heavy snowfall, according to Toyota.

Facebook Graph Search Still Doesn’t Speak Human






Despite hiring a couple of linguists to get its new search engine to move “beyond ‘Robospeak” and actually understand how people talk, Facebook hasn’t actually taught Graph Search how to do that very well just yet. And that’s a problem, no matter which way the social network spins it. Unlike Google‘s pattern-matching search engine, Facebook’s new recommendation-based social search platform tries to understand full sentences. And that takes context, something that’s very hard to teach even the smartest computers, as one of the linguists that worked on the project, Amy Campbell, told The New York Times‘s Somini Sengupta.

In order to think more like a person the Graph Search team taught the engine 25 synonyms for “student” so that when someone types in “Stanford Academics that work at Facebook” the engine knows to look for “students” — 275,000 different ways in fact. But it turns out that an English class isn’t the future of machine learning: a grammar and vocabulary lesson proves a lot easier than complex sentient thoughts, and that’s where Facebook’s new product breaks down in practice.

For example, Graph Search doesn’t get vague pronouns. My query today for “photos Elle Reeve likes that she commented on” confuses Facebook’s beyond-robo engine. Instead, Graph Search results track down photos that my Atlantic Wire colleague “likes” but that I commented on:

But Facebook’s ambiguity problem extends beyond “I” and “she.” Graph Search also has problems with double entendres, or sentences with nuance. The phrase “sports fans that like Lady Gaga play” has multiple meanings, notes the Times, especially because the word “fan” has its own special meaning on Facebook. (People with “Pages” have “fans.”)

It’s not impossible to fix these specific issues. Facebook can add more relevant “context” to Graph Search as more people use it (beta testing rolled out over the last week). But never once has a machine perfectly understood our natural language. IBM’s Watson has come close, but it still made an embarrassing mistake every so often, and newer robots like Georgia Tech’s Simon are still getting there. Messups are okay (and entertaining) for a computer on a gameshow, or robots that might end up really helping bridge the computer-human divide. But, if I’m really going to use Graph Search as a way to find things in my day-to-day life, right now, those kind of hiccups should happen rarely to never — and Facebook’s slow phase-in excuse isn’t cutting it. If Graph Search can’t understand what humans want, it’s simply not doing its job.

Lindsay Lohan’s driving case returns to LA court






LOS ANGELES (AP) — A judge who has sentenced Lindsay Lohan to jail before will conduct her first hearing Wednesday on new misdemeanor charges of lying to authorities and reckless driving against the trouble-prone actress.


Lohan has been ordered to appear before Judge Stephanie Sautner for the scheduling hearing, which is the first time the actress has been required to appear in court in nearly a year.






Prosecutors in Santa Monica, Calif., have charged Lohan with lying to police about driving a sports car that crashed into a dump truck in June, reckless driving and obstructing officers from performing their duties.


In March, Sautner released her from supervised probation but warned her to stop partying and grow up.


“You need to live your life in a more mature way, stop the nightclubbing and focus on your work,” Sautner told Lohan at the time. The admonition came after the judge conducted several monthly updates with the actress and required her to perform morgue cleanup duty to complete her sentence in a 2007 drunken driving case.


Lohan has since filmed two movies but has repeatedly gotten into trouble, including a pair of arrests in New York that have not resulted in charges.


She was on probation for theft at the time of the wreck in California, and Sautner had warned the actress she could be sentenced to 245 days in jail if she didn’t behave. She has pleaded not guilty and a Feb. 27 trial date has been set.


The latest hearing may also resolve who will be Lohan’s lawyer for the criminal case. New York attorney Mark Heller has petitioned to join the case, but his involvement must be approved by Sautner.


Heller was traveling on Tuesday and did not return a phone message.

Well: Helmets for Ski and Snowboard Safety

Recently, researchers from the department of sport science at the University of Innsbruck in Austria stood on the slopes at a local ski resort and trained a radar gun on a group of about 500 skiers and snowboarders, each of whom had completed a lengthy personality questionnaire about whether he or she tended to be cautious or a risk taker.

The researchers had asked their volunteers to wear their normal ski gear and schuss or ride down the slopes at their preferred speed. Although they hadn’t informed the volunteers, their primary aim was to determine whether wearing a helmet increased people’s willingness to take risks, in which case helmets could actually decrease safety on the slopes.

What they found was reassuring.

To many of us who hit the slopes with, in my case, literal regularity — I’m an ungainly novice snowboarder — the value of wearing a helmet can seem self-evident. They protect your head from severe injury. During the Big Air finals at the Winter X Games in Aspen, Colo., this past weekend, for instance, 23-year-old Icelandic snowboarder Halldor Helgason over-rotated on a triple back flip, landed head-first on the snow, and was briefly knocked unconscious. But like the other competitors he was wearing a helmet, and didn’t fracture his skull.

Indeed, studies have concluded that helmets reduce the risk of a serious head injury by as much as 60 percent. But a surprising number of safety experts and snowsport enthusiasts remain unconvinced that helmets reduce overall injury risk.

Why? A telling 2009 survey of ski patrollers from across the country found that 77 percent did not wear helmets because they worried that the headgear could reduce their peripheral vision, hearing and response times, making them slower and clumsier. In addition, many worried that if they wore helmets, less-adept skiers and snowboarders might do likewise, feel invulnerable and engage in riskier behavior on the slopes.

In the past several years, a number of researchers have attempted to resolve these concerns, for or against helmets. And in almost all instances, helmets have proved their value.

In the Innsbruck speed experiment, the researchers found that people whom the questionnaires showed to be risk takers skied and rode faster than those who were by nature cautious. No surprise.

But wearing a helmet did not increase people’s speed, as would be expected if the headgear encouraged risk taking. Cautious people were slower than risk-takers, whether they wore helmets or not; and risk-takers were fast, whether their heads were helmeted or bare.

Interestingly, the skiers and riders who were the most likely, in general, to don a helmet were the most expert, the men and women with the most talent and hours on the slopes. Experience seemed to have taught them the value of a helmet.

Off of the slopes, other new studies have brought skiers and snowboarders into the lab to test their reaction times and vision with and without helmets. Peripheral vision and response times are a serious safety concern in a sport where skiers and riders rapidly converge from multiple directions.

But when researchers asked snowboarders and skiers to wear caps, helmets, goggles or various combinations of each for a 2011 study and then had them sit before a computer screen and press a button when certain images popped up, they found that volunteers’ peripheral vision and reaction times were virtually unchanged when they wore a helmet, compared with wearing a hat. Goggles slightly reduced peripheral vision and increased response times. But helmets had no significant effect.

Even when researchers added music, testing snowboarders and skiers wearing Bluetooth-audio equipped helmets, response times did not increase significantly from when they wore wool caps.

So why do up to 40 percent of skiers and snowboarders still avoid helmets?

“The biggest reason, I think, is that many people never expect to fall,” says Dr. Adil H. Haider, a trauma surgeon and associate professor of surgery at Johns Hopkins University in Baltimore and co-author of a major new review of studies related to winter helmet use. “That attitude is especially common in people, like me, who are comfortable on blue runs but maybe not on blacks, and even more so in beginners.”

But a study published last spring detailing snowboarding injuries over the course of 18 seasons at a Vermont ski resort found that the riders at greatest risk of hurting themselves were female beginners. I sympathize.

The takeaway from the growing body of science about ski helmets is in fact unequivocal, Dr. Haider said. “Helmets are safe. They don’t seem to increase risk taking. And they protect against serious, even fatal head injuries.”

The Eastern Association for the Surgery of Trauma, of which Dr. Haider is a member, has issued a recommendation that “all recreational skiers and snowboarders should wear safety helmets,” making them the first medical group to go on record advocating universal helmet use.

Perhaps even more persuasive, Dr. Haider has given helmets to all of his family members and colleagues who ski or ride. “As a trauma surgeon, I know how difficult it is to fix a brain,” he said. “So everyone I care about wears a helmet.”

BlackBerry 10’s Debut Is a Critical Day for Research in Motion





OTTAWA — Research in Motion’s introduction on Wednesday of a new BlackBerry phone will be the most important event in the company’s history since 1996, when its founders showed investors a small block of wood and promised that a wireless e-mail device shaped like that would change business forever.




Now with just 4.6 percent of the global market for smartphones in 2012, according to IDC, RIM long ago exchanged dominance for survival mode. On Wednesday, the company will introduce a new line of smartphones called the BlackBerry 10 and an operating system of the same name that Thorsten Heins, the president and chief executive of RIM, says will restore the company to glory.


But Frank Mersch, who became one of RIM’s earliest investors after seeing the block of wood, is far less excited by what he sees this time around.


“You’re in a very, very competitive market and you’re not the leader,” Mr. Mersch, now the chairman and a vice president at Front Street Capital in Toronto, said of RIM. “You have to ask: ‘At the end of the day are we really going to win?’ I personally think the jury’s out on that.”


The main elements of the new phones and their operating system are already well known. Mr. Heins and other executives at RIM have been demonstrating the units for months to a variety of audiences. App developers received prototype versions as far back as last spring.


While analysts and app developers may be divided about the future of RIM, there is a consensus that BlackBerry 10, which arrives more than year behind schedule, was worth the wait.


Initially RIM will release two variations of the BlackBerry 10, one a touch-screen model that resembles many other phones now on the market. The other model is a hybrid with a keyboard similar to those now found on current BlackBerrys as well as a small touch screen.


The real revolution, though, may be in the software that manages a person’s business and personal information. It is clearly designed with an eye toward retaining and, more important, luring back, corporate users.


Corporate and government information technology managers will be able to segregate business-related apps and data on BlackBerry 10 handsets from users’ personal material through a system known as BlackBerry Balance. It will enable an I.T. manager to, among other things, remotely wipe corporate data from fired employees’ phones while leaving the newly jobless workers’ personal photos, e-mails, music and apps untouched. The system can also block users from forwarding or copying information from the work side of the phone.


Messages generated by e-mail, Twitter, Facebook, instant messaging and LinkedIn accounts are automatically consolidated into a single in-box that RIM calls BlackBerry Hub.


Charles Golvin, an analyst with Forrester Research, called the new phones “beautiful” and described the operating system as “a giant leap forward” from RIM’s current operating system. Ray Sharma, who followed RIM’s glory years as a financial analyst but who now runs XMG Studio, a mobile games developer in Toronto, has been similarly impressed.


But both men are among many analysts who question the ability of BlackBerry 10, whatever its merits, to revive RIM’s fallen fortunes.


“If it’s good, it will help inspire the upgrade cycle,” Mr. Sharma said. “But it has to be great in order to inspire touch-screen users to come back. If it’s good, not great, I will be concerned.”


Mr. Golvin was more blunt. “They’ll need to prove themselves in the face of a simultaneous onslaught of marketing from Microsoft, not to mention the continued push from Apple plus Google and its Android partners,” he wrote. “This is a gargantuan challenge for a company of RIM’s size.”


In the year since he took over from the founders, Jim Balsillie and Mike Lazaridis, Mr. Heins has certainly remade RIM. He cut 5,000 jobs in a program to reduce operating costs by about $1 billion a year. Along the way, he also replaced RIM’s senior management and straightened out its balance sheet. While unprofitable, RIM remains debt-free and holds $2.9 billion in cash.


With BlackBerry 10, RIM not only started over with its operating system, it also rebuilt the company through acquisitions. Its core operating system comes from QNX Software Systems, the design of the user interface is largely the work of the Astonishing Tribe in Sweden while other main components, like the touch-screen technology, came from smaller companies that are now part of RIM.


Integrating all of those acquisitions, analysts and former RIM employees say, added to the delays that plagued BlackBerry 10.


Now that the new phones are finally here, Mr. Heins is counting on RIM’s remaining base of 79 million users globally to eagerly upgrade. But where those customers reside may be as important in their numbers in determining the success of that plan.


In the United States, which leads the world in setting smartphone trends, about 11 million BlackBerry users switched to other phones between 2009 and the middle of last year, according to an analysis by Horace Dediu on Asymco, a wireless industry blog he founded.


Until the final months of 2012, RIM continued to increase its subscriber base through sales of low-cost handsets to less developed countries like Nigeria and Indonesia. Although BlackBerry 10 will be made available worldwide, the initial phones will be too expensive for a majority of BlackBerry fans in those regions.


RIM may also have confused its loyalists, particularly in North America and Europe, in the run-up to the BlackBerry 10 debut. Many of those users stuck with BlackBerrys because of their physical keyboards. But public demonstrations for BlackBerry 10 were centered on the touch-screen-only version and its virtual keyboard.


While some corporations have remained loyal to BlackBerry, RIM not only has to sell them on the new handsets, it also must persuade them to upgrade server software to accommodate the new operating system, a costly and time-consuming process. Companies whose employees continue to use older BlackBerrys will have to run two separate BlackBerry servers.


Mr. Heins’s pitch to those corporations is that the BlackBerry 10 server software will also allow them to manage and control data on employees’ Android phones and iPhones. But any corporation or organization that allows those phones to connect with its systems long ago installed mobile device management software from other companies, including Good Technology and SAP. RIM is likely to find that the competition in device management software is as severe as it is in the handset business.

Mayoral debate focuses on city's troubled finances









In the highest-profile debate so far in the Los Angeles mayoral race, three longtime city officials defended their records Monday night as two long-shot challengers accused them of putting the city on a path to insolvency.


The city's chronic budget shortfalls dominated the event at UCLA's Royce Hall, televised live on KNBC-TV Channel 4. Entertainment lawyer Kevin James and technology executive Emanuel Pleitez sought to maximize the free media exposure, portraying themselves as fresh alternatives to business as usual at City Hall.


James, a former radio talk-show host, described himself as an independent and accused rivals Wendy Greuel, Eric Garcetti and Jan Perry — all veteran elected officials — of being cozy with unions representing the city workforce.





"Bankruptcy doesn't happen overnight," said James, the only Republican in the race. "This happened over a period of time and it happened because of a series of bad decisions."


Pleitez struck a similar note.


"Our politicians in the last decade made decisions on numbers they didn't understand," he said.


"I'm the only one that has worked in the private sector and on fiscal and economic policies at the highest levels," Pleitez said, citing his experience as a special assistant to economist Paul Volcker on President Obama's Economic Recovery Advisory Board.


Greuel, Garcetti and Perry, in turn, pledged to show fiscal restraint as the city grapples with projected budget shortfalls totaling more than $1 billion over the next four years.


City Controller Greuel cited the "waste, fraud and abuse" her office's audits have identified at City Hall, saying they demonstrate her independence.


"As mayor of Los Angeles, I get not only being the fiscal watchdog, and showing where we can find this money, and knowing where the bodies are buried," said Greuel, who served on the City Council for seven years. "I've learned as city controller, you don't always make friends when you highlight what can be done better."


Garcetti, a councilman for more than a decade, said he had a record of "not just talking about pension reform, but delivering on it." When tax collections dried up in the recession, he said, the council and mayor eliminated 5,000 jobs and negotiated a deal with unions requiring some city workers to contribute to their health and pension benefits.


"Those are the things that kept us away from our own fiscal cliff," he said.


Perry also stressed her support for increasing worker contributions to health and retirement benefits.


"This is about long-term survival," she said.


By the normal standards of election campaigns, it was a remarkably genteel debate, at least among the three city officials.


Only Perry attacked her rivals, and even then, not by name.


Recalling her work with Garcetti and Greuel in talks with city unions, she faulted them for engaging in "side meetings and side negotiations," saying she was more transparent.


"As mayor, I will make sure that practice stops, that everything is done on the record — that all employees are treated fairly and all employees are given the same information," Perry said.


Neither Greuel nor Garcetti answered the attack.


As in previous forums, the most obvious contrasts among the candidates Monday night were in biography and style — rather than policy positions.

Yahoo sees revenue climb this year, but long road ahead






(Reuters) – Yahoo Inc forecast a modest uptick in revenue for the current year as it revamps its family of websites but Chief Executive Marissa Mayer warned it would be a long journey to revive the Internet company‘s fortunes.


In Yahoo‘s first financial outlook since Mayer became CEO in July, the company outlined a plan to trigger a “chain reaction of growth” by overhauling a dozen of its online services to increase the amount of time users spent on its websites.






It also pointed to strength in its search advertising business and progress made in improving its internal operations.


Yahoo’s shares were 3 percent higher in after hours trade after the revenue projection was disclosed during an analysts conference call, shedding some ground after earlier rising as much as 4.5 percent.


But weakness in Yahoo’s display ad business, which accounts for roughly 40 percent of the company’s total revenue, caught some analysts by surprise.


“While the road to growth is certain, it will not be immediate,” said Mayer, a former Google Inc executive and Yahoo’s third full-time CEO since September 2011.


Yahoo said that revenue, excluding fees it pays to partner websites, will range between $ 4.5 billion and $ 4.6 billion in 2013, implying an annual growth rate of 0.7 percent to 3 percent.


Finance Chief Ken Goldman also warned investors to expect “an investment phase” in the first half of the year, which he said would impact profit margins.


“What was clear from the call is that this is a long-term turnaround story,” said Macquarie Research analyst Ben Schachter. “We shouldn’t expect anything to just snap back and correct itself.”


During the fourth quarter, Yahoo’s net revenue increased 4 percent year-on-year to $ 1.22 billion, as search advertising sales offset a 10 percent decline in the number of display ads sold on Yahoo’s core properties.


Mayer said the decline was the result of less activity by visitors to its popular websites, such as its Web email service, and to a lesser extent due to users accessing the Web on smartphones, where Yahoo’s ad business is not as strong.


Efforts to revamp its mobile properties, begun last year with a redesign of the photo-sharing service Flickr, remain on track, said Mayer, noting that Yahoo now has 200 million monthly mobile users.


“From a monetization perspective this is still a very nascent source of revenue for us. With any platform shift, revenue always followed users and mobile will be no different,” she said.


Mayer took over after a tumultuous period at Yahoo in which former CEO Scott Thompson resigned after less than 6 months on the job over a controversy about his academic credentials and in which Yahoo co-founder Jerry Yang resigned from the board and cut his ties with the company.


Yahoo’s stock has risen roughly 30 percent since Mayer took the helm, reaching its highest levels since 2008.


Part of the stock’s rise has been driven by significant stock buybacks, using proceeds from a $ 7.6 billion deal to sell half of its 40 percent stake in Chinese Internet company Alibaba Group, said Sameet Sinha, an analyst with B. Riley Caris.


Yahoo said it repurchased $ 1.5 billion worth of shares during the fourth quarter.


The company’s fourth-quarter net income was $ 272.3 million, or 23 cents per share, versus $ 295.6 million, or 24 cents per share in the year-ago period.


Excluding certain items, Yahoo said it had earnings per share of 32 cents, versus the average analyst expectation of 28 cents according to Thomson Reuters I/B/E/S.


For the first quarter, Yahoo said it expects revenue, excluding partner website fees, of $ 1.07 billion to $ 1.1 billion, trailing the $ 1.1 billion that Wall Street analysts expect on average.


Shares of Yahoo were up 59 cents at $ 20.90 in after-hours trading on Monday.
